TAN SHOULD BE BARRED FROM RUNNING

I agree that Vivienne Tan should be disqualified from running. The inquirer notes ....

“The court of appeals has barred a daughter of taipan Lucio Tan from running for Congress in the first district of Quezon City on the ground that she is not a registered voter.

In a ruling dated April 20, a special division of the appellate court’s Eighth Division ordered the Commission on Elections (Comelec) to remove Vivienne Tan’s name from the voters’ list in Precinct 0853-A of Barangay Sto. Domingo, Quezon City.

Should the poll body comply with the court’s order, this would bar Tan from running for public office because under the law, candidates should be registered voters.

“Tan’s inclusion in the voter’s list … is invalid since she was not a Filipino citizen at the time of such registration and the law is clear that an individual must be a citizen of the Philippines for him to validly register as a voter,” the appellate court said through Associate Justice Normandie Pizarro.

The court thus upheld a ruling by Quezon City Metropolitan Trial Court Judge Augustus Diaz who said that Tan could not run for office due to questions about her citizenship.

According to the appellate court, the citizenship of an individual was the “first all-important factor” in determining whether or not the person may qualify as a voter.

Based on court records, the 42-year old Tan became a naturalized American citizen on Jan. 19, 1993.

On Oct. 26 last year, she applied for registration as a voter by presenting a Filipino passport issued a month earlier. Her application was approved by Comelec on Nov. 16.

On Nov. 30, she took an oath of allegiance to the Republic of the Philippines, a day before she filed her certificate of candidacy.

On Dec. 1, she also filed a petition to reacquire her Filipino citizenship which the Bureau of Immigration approved that same day.

“Prior to Nov. 30, 2009 (when she took her oath of allegiance to the Philippines), Tan was a naturalized American citizen and thus cannot be deemed as a Filipino citizen residing in the Philippines,” the court said.

“Not being a Filipino citizen at the time of her application to be registered as a voter on Oct. 26, 2009, or at the time when her application was approved by the Comelec on Nov. 16, 2009, Tan’s inclusion in the voter’s list … is therefore highly irregular and downright invalid,” it added.

Tan had insisted that she already renounced her American citizenship in 1996 when she returned to the country permanently.

But the Court of Appeals said the defect in her voter’s registration was not corrected by her subsequent reacquisition of Philippine citizenship.

“Irrefragably, Philippine citizenship previously disowned is not and must not be allowed to be cheaply recovered,” it said.

Reached for comment, Tan’s lawyer maintained that her client is a Filipino and therefore a valid candidate.

“Her name appears in the ballot and an overwhelming majority will vote for her,” Trixie Angeles said.

She claimed that the appellate court’s decision was a reversible error because its findings run counter to new laws on citizenship, adding that the ruling was not yet final.

Tan’s other lawyer, Christian Robert Lim said: “It is clear that the Court of Appeals has disregarded clear provisions of the dual citizenship law,” adding that they would bring the case even to the Supreme Court.

Tan is running against Rep. Vincent “Bingbong” Crisologo who filed the case against her at the metropolitan trial court.” PDI

The 106 Million went to my Malunggay Project

The malunggay propagation campaign has invaded posh subdivisions in Quezon City, with me, Vice Mayor Herbert Bautista, leading the launch of the Halamanan sa Bakuran project at the Tivoli Royale Subdivision.

Our project was launched as a complementary program to the malunggay planting program in urban poor communities in the city and is meant to promote the cultivation of the vegetable, which is also a source of Vitamin A, iron, zinc and other micronutrients.

This is where we spent the 106 million that is maliciously being charged of me. Malunggay is good for the health and good for the family. I'm sure you will all agree!
